Welcome to Elk Mountain Wellness Concierge (“we,” “us,” or “our”). By booking or participating in our in-home wellness services (massage, yoga, fitness) in Colorado, you agree to the following terms and conditions. Please review these policies carefully before booking.

1. General Terms

  • Clients must be 18 years or older, or accompanied by a parent/guardian during the service.

  • Services are by appointment only, subject to availability.

  • We reserve the right to refuse or discontinue service for any reason including unsafe environment, inappropriate behavior, or health concerns.

  • Our practitioners are licensed (where required) per Colorado law and carry insurance as required. For example, for massage therapists in Colorado: §12-235-116 requires maintenance of professional liability insurance. Justia

2. Payment & Gratuity

  • Full payment is required at the time of booking to confirm the appointment.

  • A gratuity is automatically included in the total service fee, unless otherwise specified.

  • Accepted payment methods: credit/debit card, approved online payment platform (as disclosed at booking).

3. Cancellation & Refund Policy

  • 50% refund if cancelled 7 or more days before the scheduled service date.

  • 25% refund if cancelled 4 to 6 days before the scheduled service date.

  • No refund if cancelled 3 or fewer days before service date, or if service is missed / access is not provided.

  • If we must cancel due to provider illness, emergency, or other unforeseen circumstances, you will receive a full refund or option to reschedule.

4. Health & Safety

  • You agree to disclose all relevant health information (medical conditions, injuries, allergies, medications, etc.) prior to services.

  • Our practitioners are not medical doctors and do not provide medical diagnoses, treatments, or prescriptions — services are for wellness, relaxation, and general fitness only.

  • You should consult your doctor before beginning any fitness or yoga program if you have health issues.

  • We follow strict hygiene, sanitation, and equipment-cleaning protocols for all sessions.

  • You agree to provide a safe, clean, and private environment for in-home services.

5. Liability Waiver & Indemnification

By engaging in services provided by Elk Mountain Wellness Concierge, you acknowledge and accept the following:

  • You are participating voluntarily and assume full responsibility for any risks, injuries, or damages (known or unknown) that may result.

  • Elk Mountain Wellness Concierge, its owners, employees, contractors, and affiliates are not liable for any injury, loss, or damage (including death) arising out of or resulting from your participation, except in cases of gross negligence or willful misconduct.

  • You agree to release, hold harmless, and indemnify Elk Mountain Wellness Concierge and its staff from any claims, demands, liabilities, costs, or expenses (including attorney’s fees) arising from or related to your participation in the services.

6. Legal Compliance – Colorado

  • Our massage services comply with Colorado Revised Statutes § 12-235-101 et seq. including § 12-235-116 requiring professional liability insurance for massage therapists operating in Colorado. Justia

  • This policy is governed by the laws of the State of Colorado. Any dispute arising under or relating to this agreement shall be resolved in accordance with Colorado law.

7. Privacy Policy

  • We respect your privacy. Personal information (name, contact info, health disclosures, payment data) is collected and used solely for scheduling, service provision, billing, and communication.

  • We will not share your personal data with third parties except as required by law.

  • If you have questions or wish to access, correct, or delete your personal information, please contact us through the details below.

8. Code of Conduct

Clients must:

  • Provide a safe, clean, and private environment for the practitioner.

  • Refrain from inappropriate, disrespectful, or unsafe behavior. Any misconduct grants us the right to terminate service immediately and without refund.

  • Respect the practitioner’s time and professionalism.

  • If you are not present at the scheduled time/location, that may be treated as a missed appointment (non-refundable).

9. Modifications to These Terms

Elk Mountain Wellness Concierge reserves the right to change, update, or modify these terms and policies at any time. The updated version will be posted on our website, and continued use of our services constitutes acceptance of the revised terms.

10. Policy on Dissatisfied Services

At Elk Mountain Wellness Concierge, we take great care in selecting only the most qualified, professional, and well-trained wellness practitioners. Our team is chosen for their expertise, integrity, and commitment to excellence.

We value your feedback and are always open to hearing how we can make your experience even better. If you are ever dissatisfied or have concerns regarding your service, please contact us directly and promptly so we can discuss the situation and work together toward a resolution.

Please note that it is considered a rare and exceptional circumstance for refunds to be issued based on service dissatisfaction. We trust our practitioners to make all decisions in alignment with their professional judgment and moral code, and we stand behind their expertise. However, we welcome all feedback as part of our continuous effort to maintain the highest standards of service and care.
